Foreclosures in Oregon

Foreclosures allow a creditor or bank to repossess property from a debtor who has failed to pay their mortgage. Oregon allows two types of foreclosures:

  • Foreclosure by judicial sale occurs under the supervision of a court after a lawsuit has been filed for a court order to foreclose on a property. After all parties with an interest in the property have been notified, the property is auctioned to the highest bidder. Proceeds from the sale close out the mortgage and any remaining funds are divided between other lien holders.
  • Foreclosure by non-judicial sale, also known as foreclosure by power of sale, is much more common in Oregon. Non-judicial sale foreclosures do not go through a court process and are typically faster than judicial sales as they follow procedures outlined in the power of sale clause of the mortgage. The property is conveyed from the mortgage holder to the trustee through a deed of trust. The basic steps are the same as those of a judicial foreclosure.
